And finally, experts have commented on the absence of foreign bribery charges in the US indictment against FIFA officials. The recipients of the bribes would not be considered ‘foreign officials’ under the Foreign Corrupt Practices Act, hence the indictment could not draw on the FCPA anti-bribery provisions. Instead the prosecutors used the RICO (Racketeer Influenced and Corrupt Organizations Act) and Travel Act to lodge the allegations.
